SEVEN YEAR EXTENDED DEFECTIVE LABOR
(LIMITED WARRANTY)

RELIABLE will, for a period of seven (7) years from the date of substantial completion, replace and install any part found to have a substantial defect in it due to defective labor performed by any of Reliable's tradesman / subcontractors. (Defective labor that may be found in a product manufactured by others, such as material / product suppliers are not covered under this warranty and whatever warranty then in effect by specific material /product suppliers will apply) except as hereinafter set forth. In no event shall Reliable's liability for damage, whether under warranty or otherwise, exceed the cost of repair or replacement of defective materials or workmanship. Reliable's management reserves the right to determine whether or not said defect(s) are due to defective labor or other causes and said determination shall be final and binding on all parties.

RELIABLE does not warrant any of the following:

a) Concrete work against, but not limited to, peeling, cracking, chipping, flaking, over-finishing,depressions, water pockets, pitch, honey cones, crowns, bows, low spots or the finish of any concrete that is rained on before concrete can harden, and freezing of any concrete that is poured in the fall or winter of any given year, "September through April".

b) Water pipes that freeze, burst or leak if installed in exterior wall(s) or unheated crawl space or attic; or any other unheated rooms or areas;

c) Adequacy of heating or air conditioning where improvements to be constructed requires tying into existing heating or air conditioning system;

d) Vinyl siding against, but not limited to, expansion, contraction, buckling or cracking;

e) Cracking or warping of wood exposed to weather;

f) Warping, swelling, or shrinkage of wood doors and windows due to changing weather conditions;

g) Color and textures match of any new exterior wall covering(s)/roofing to existing structure(s), also walls and floor coverings.

h) Roof leaks, when new addition is tied into existing house roof and subsequent roof leaks are determined to be due to poor condition of existing roofing shingles or sheathing or pre-existing siding, cracks/cracked or missing caulking. Also Reliable shall not be liable for any damage done by "ice damming” (if any) in winter months.

i) Settling of concrete foundations/piers due to consistency of below grade soil or water table or drainage of surface water for lot or area or any other condition beyond Reliable's control.

j) Drywall cracks to be touched up once only in the eleventh (11) month after substantial completion of project. Reliable is not liable for any repainting, wall papering or re-decorating of any nature.

k) NO IMPLIED WARRANTIES

BUYERS EXPRESSLY ACKNOWLEDGE THAT THE WARRANTIES CONTAINED HEREIN ARE THE ONLY WARRANTIES MADE BY RELIABLE AND ARE MADE IN LIEU OF ANY AND ALL WARRANTIES IMPLIED BY LAW INCLUDING, BUT NOT LIMITED TO, THE WARRANTY OF FITNESS FOR ANY PARTICULAR PURPOSE OR USE OR MERCHANTABILITY OR THE IMPLIED WARRANTY OF HABITABILITY. BUYERS UNDERSTAND THAT THE EXCLUSION OF ALL IMPLIED WARRANTIES LIMIT BUYERS' RIGHTS AGAINST RELIABLE FOR ANY DEFECTS TO SOLELY THE CORRECTION OF DEFECTS AS HEREIN WARRANTED. BUYERS FURTHER ACKNOWLEDGE THAT RELIABLE'S WARRANTY HEREUNDER EXCLUDES SPECIFICALLY RESPONSIBILITY ON THE PART OF RELIABLE FOR ALL SECONDARY OR CONSEQUENTIAL DAMAGE AND/OR LOSSES WHICH MAY ARISE FROM OR OUT OF ANY AND ALL DEFECTS IN CONNECTION WITH THE CONSTRUCTION OF THE IMPROVEMENTS. BUYERS FURTHER EXPRESSLY ACKNOWLEDGE THAT RELIABLE HAS NOT MADE ANY WARRANTY OTHER THAN THOSE EXPRESS WARRANTIES CONTAINED HEREIN.
